In an August 29 decision, board vice-chair Susan de Avellar Schiller ruled that the OMB does not have the jurisdiction to amend by-laws to increase development charges. The question was posed under an appeal by Antony Niro of the City of Vaughan’s development charge by-law. Niro seeks the increase in development charges to fund infrastructure improvements to Kirby Road.
Both the city and Niro, who remains the only appellant of the 2013 Vaughan Development Charge By-law, indicated they needed time to consider the implications of the board’s decision. The board set a teleconference for September 16 for the parties to determine their next steps.
