GTA OMB News: Vaughan granted partial approval of secondary plan

May 14, 2014

In a decision issued April 10, board member Jason Chee-Hing granted a motion by Di Poce Management Ltd. and others (“Landowners”) to grant partial approval of the West Vaughan Employment Area secondary plan. This hearing was part of appeals by 1042710 Ontario Limited (Royal Centre), 1191621 Ontario Inc., 1529749 Ontario Inc. and 1541677 Ontario Inc. of the City of Vaughan’s failure to make a decision regarding an official plan amendment with respect to the Vaughan Metropolitan Centre and the West Vaughan employment area secondary plan.

Vaughan solicitor Claudia Storto informed the board that agreement had been reached concerning modifications to the secondary plan. City planner Steven Dixon also provided evidence regarding the modified plan. Dixon told the board that the revisions conform to the official plan and are consistent with the Provincial Policy Statement and Growth Plan for the Greater Golden Horseshoe.

The board agreed with Dixon and found the modified plan represented good planning. It granted the motion, in part, but withheld its order until the revised draft is received from the city.

Solicitors involved in the case are city solicitor Claudia Storto and Dawne Jubb (Dawne Jubb Barrister) representing the City of Vaughan; Pitman Patterson (Borden Ladner Gervais LLP) and regional solicitor Frank Santaguida representing York Region; Thomas Barlow and Sarah Turney (Fasken Martineau LLP) representing Di Poce Management Limited; Susan Rosenthal and Jason Lewis (Davies Howe Partners LLP) representing Highway 7 Langstaff GP Ltd.; Patrick Harrington (Aird and Berlis LLP) representing Amar Transport Inc.; Katarzyna Sliwa (Davies Howe) representing Block 66 West Landowners Inc.; Steven Ferri (Loopstra Nixon LLP) representing Kirbywest Ltd.; and Joshua Paquin representing the Ministry of Municipal Affairs and Housing.
