Hearing set for Vaughan appeal

In a September 26 decision, board member Maureen Carter-Whitney set a third pre-hearing conference for appeals by West Rutherford Properties Ltd. regarding the City of Vaughan’s failure to make a decision on zoning by-law and official plan amendments. The board also set July 6, 2015 for the start of a 10-day hearing. West Rutherford Properties seeks to develop two 12-storey apartment buildings and 21 townhouse units on its lands at 3660 Rutherford Road in the City of Vaughan.

Party status was granted to Rutherford Commercial Holdings Limited and Loblaw Properties Limited. Participant status was granted to the Vellore Woods Ratepayers Association.

West Rutherford Properties counsel Bruce Ketcheson (Ritchie Ketcheson Hart Biggart LLP) told the board that revised plans had been submitted and requested a third prehearing conference.

The board agreed, setting a prehearing conference for February 19, 2015.
