In a June 19 decision, board member Mary-Anne Sills allowed an appeal, in part, by Mohsen Charmchy against the City of Vaughan committee of adjustment’s refusal of a minor variance application for his property at 21 Mill Street.

Charmchy sought variances to construct a two-storey detached dwelling within the Thornhill Heritage Conservation District.

The board was informed at the outset of the hearing that the parties have reached a settlement involving modifications to siting and design elements of the proposed dwelling.

Planner Alan Young (Weston Consulting Group Inc.) and city planner Gillian McGuinness testified in support of the settlement stating that the proposal is consistent with the principles of good land use planning.

The board agreed with the evidence provided and allowed the appeal subject to conditions.

Solicitors involved in this decision were Michael Simaan (Kramer Simaan Dhillon LLP) representing Mohsen Charmchy and Dawne Jubb representing the City of Vaughan. (See OMB Case No. PL140494.)
