In an August 19 decision, board member Jason Chee-Hing allowed an appeal by D’Addurno Investments against the City of Vaughan committee of adjustment’s refusal of its minor variance application for 29 Goodman Crescent.

D’Addurno’s initial appeal was heard April 1. During that hearing, the board expressed concerns with the roof massing, loft area and lot coverage of the proposed dwelling. The board declined to authorize variances to permit the proposal and offered D’Addurno an opportunity to redesign the proposed home to address the board’s concerns. D’Addurno revised the roof structure of its proposed home and requested a continuation of the hearing.

The modified variances reduce the requested height from 9.89 to 7.61 metres, the maximum loft area from 43.3 to 41.58 per cent, and maintain the requested 29.3 per cent maximum lot coverage.

Planner Mark Yarranton (KLM Planning Partners) provided evidence on behalf of D’Addurno in support of the modified proposal. He testified the revised proposal reduces the visual impact of the roof structure from the street, and the home will be consistent with the physical character of the neighbourhood.

Neighbour Gerhard Schiller, who opposed the proposal at the earlier hearing, attended the continuation and described the revised home as still oversized and incompatible with the neighbourhood.

The board agreed with Yarranton’s evidence and allowed the appeal with conditions prohibiting both the conversion of the attic to habitable living space and the enclosure of the rear loggia to facilitate a year-round living space.
